                                                        September 5, 2000

The regular meeting of the Town Board was held on Tuesday, September 5, 2000 in the Erich Gnant Room of the Town Hall, 645 N Janacek Road, Brookfield, WI.

Chairman Keith Henderson called the meeting to order at 7:00 p.m. with the following people present: Supervisors: Jeffrey Timm, Keith Harenda and Leo Talsky, Attorney James Hammes, Administrator Richard Schultz and the Town Clerk to record the minutes.

MEETING NOTICE VERIFICATION

The Clerk reported that notice of this meeting was faxed to the newspapers and posted at the Town Hall on September 1, 2000. The Police Department posted the notice on September 1, 2000 on the bulletin boards located on Woelfel Road & Wisconsin Avenue, Mayrose Boulevard, Davidson Road, Weyer Road and Marx Park. The Addendum was faxed to the newspapers and posted at the Town Hall on September 5, 2000. The Police Department posted the notice on the bulletin boards located at Mayrose Blvd, Weyer Road, Wisconsin Ave and Woelfel Road, Davidson Road and Marx Park on September 5, 2000.

MINUTES

Supervisor Timm moved to dispense with the reading of the minutes of the June 20, 2000 Town Board meeting and approve them as presented, seconded by Supervisor Harenda, voted on, passed 2 –0 – 1. Chairman Henderson abstained because he was not at the June 20, 2000 meeting.

Supervisor Harenda moved to dispense with the reading of the minutes of the August 1, 2000 Town Board meeting and approve them as presented, seconded by Supervisor Timm, voted on, carried unanimously.

PUBLIC COMMENT None.

BOARD OF REVIEW DATE

Supervisor Harenda moved to approve October 28, 2000 at 8:00 a.m. as the date for the Board of Review to adjourn to on Saturday, September 9, 2000, seconded by Supervisor Timm, voted on, carried unanimously.

TOWN HALL, FIRE, POLICE AND PUBLIC WORKS DEPARTMENT BUILDING PROJECT

Supervisor Harenda motioned to moved the addendum item (the Town building project) up on the agenda for an updated presentation to the Town Board, seconded by Supervisor Timm, voted on, carried unanimously.

Supervisor Carol Johnson entered the room (7:05 p.m.).

John Sabinash, Architect from the Zimmerman Design Group explained that they would be presenting what is classified as a working plan subject to changes. The systematic site plans are together for the September 19, 2000 meeting and what that they are looking at proposing is the construction of a Public Works building on the north of the property in the area of the existing Police Department Public Works building. The renovation of the Town Hall which will include a two story addition to the west of the building extending south on the site to house the police department. A courtyard between the fire and police department will be created that will define the emergency vehicle ingress and egress access. The building proposal includes the construction of a new larger meeting room and turning the existing meeting room into conference and clear defined public access point.

One of the main things identified was to get a nicer entrance point into the building with the existing entrance off Janacek tying into the future green space to be developed to the rear of the site. There will be parking between the two buildings with a boulevard at the entryway to create an important focal point to the site.

John Stoltze of Zimmerman Design Group explained that the proposal is to enclose the existing vestibule and create a large public lobby area with counter space that extends across the entire area. This area presently only serves one part of the building where this will service a number of functions and the whole building. There will also be renovation of the Fire Department area to bring it up to the ADA standards and the addition of storage rooms, mechanical and repair area. The addition will house the Police Department Administration operations on the upper level. The lower level will include the vehicle fleet area, booking and interviewing rooms, storage of evidence, equipment, property and etc. There will also be a joint training room for the police & fire department in the lower level and the location of the elevator to be utilized by both departments.

There will be an outside fire department training area behind the building on the west side of the property.

The construction of the Public Works building is to allow for the storage of the vehicles, equipment and tools and allow for access to any of them without much difficulty. The existing building, the pole barn and the park and recreation storage shed will be replaced and the building will included administrative office area, highway department and park and recreation storage areas and other work and rest areas.

REQUEST FOR AN EXTENSION FOR PROPERTY CLEAN UP AT 21785 WEYER ROAD

Supervisor Johnson moved to approve an extension of sixty days (October 31, 2000) for John King to clean up the property at 21785 Weyer Road, seconded by Supervisor Talsky, voted on, carried unanimously.

PICNIC PERMIT

Supervisor Talsky moved to grant an Alcohol Picnic Permit for September 7, 2000 from 4:00 p.m. to 8:00 p.m. at Marx Park, seconded by Supervisor Timm, voted on, carried unanimously.

PICNIC PERMIT

Supervisor Johnson moved to grant an Alcohol Picnic Permit for September 10, 2000 from 11:00 a.m. to 6:00 p.m. at Marx Park, seconded by Supervisor Harenda, voted on, carried unanimously.

DAVIDSON ROAD BRIDGE BID

Supervisor Harenda moved to award the Davidson Road Bridge Replacement contract, in the amount of $176,587.90 to Lunda Construction Co., seconded by Supervisor Timm, voted on, carried unanimously.

HEATHERVIEW DITCH BID

Supervisor Harenda moved to award the Heatherview Storm Sewer contract, in the amount of $237,292.00 to Mainline Sewer & Water Inc., seconded by Supervisor Talsky, voted on, carried unanimously.

BROOK PARK POND SOIL TESTS

Supervisor Johnson moved to approve the proposal submitted by Wisconsin Testing Laboratories for performing the sampling and laboratory testing for Brook Park Pond soil testing, seconded by Supervisor Harenda, voted on, carried unanimously.

KMART DETENTION BASIN STUDY

Supervisor Johnson moved to set Thursday, September 26, 2000 at 7:00 p.m. as the meeting date for the Town Board, Storm water Committee and all principals involved with contributing to the K-mart Detention Basin, seconded by Supervisor Harenda, voted on, carried unanimously.

2001 ROAD PROGRAM EVALUATION

Supervisor Johnson moved to approve the Graef, Anhalt, Schloemer & Associates, Inc. Pavement and Drainage Maintenance Program Civil Engineering Proposal, not to exceed $25,000.00. seconded by Supervisor Harenda, voted on, carried unanimously. The funding is to come from the Road Program Capital Improvement Fund and Storm Water Capital Improvement Fund.

TRICK OR TREAT DATE

Supervisor Harenda moved to set Tuesday, October 31, 2000 from 6:00 p.m. to 8:00 p.m. as the date and time for Trick or Treat, seconded by Supervisor Timm, voted on, carried unanimously.

SEPTEMBER 19, 2000 TOWN BOARD MEETING

Supervisor Talsky moved to reschedule the September 19, 2000 Town Board/Staff meeting and the Town Board meeting to Wednesday, September 20, 2000 at 6:00 p.m. and 7:00 p.m., seconded by Supervisor Timm, voted on, carried unanimously.

HAZARDOUS MATERIAL INCIDENT ON APRIL 11, 2000

Supervisor Johnson moved to send the bill for the April 11, 2000 Hazardous Material Incident on Barker Road to Waukesha County and review the contract. Also, send a letter to the Hazmat team explaining that the since the incident occurred on a county roadway the Town’s decision was to forward the billing to the County and review the Haz-Mat contract, seconded by Supervisor Timm, voted on, carried unanimously.

BARTENDER LICENSES

Supervisor Harenda moved to approve bartender licenses for the people on the attached list dated September 5, 2000 – June 30, 2001, seconded by Supervisor Talsky, voted on, carried unanimously.

BUILDING INSPECTOR’S REPORT

Inspector Lake reported that the cooling system for the Town Hall meeting room has not been functioning properly. He requested the company that performs the periodic maintenance on the Town’s system look at it and they have determined that a compressor is bad. It is a problem beyond their ability to rebuild the compressor and has suggested that a HVAC company be contacted to check the system and give an estimate on repair costs. Envira Tech was contacted and did a diagnostic testing and agrees that the compressor is not operating properly and has recommended that it be replaced.

He also explained that in the middle of July he sent correspondence to Watertower Associates regarding the escrow funds for the final lift of asphalt on Watertower Boulevard. There is approximately $17,000.00 in the account and the estimate received from Payne and Dolan is for $35,000.00 and he has heard nothing from the representative of Watertower Associates and suggests that this be turned over to the Town Attorney. The Board agreed.

Inspector Lake reported that ANR Pipeline took steps to screen the gas line valve area on Timberline Drive by painting it camouflage green and the fence painted also. He also presented photos of the area flooded.

VOUCHERS

Supervisor Johnson moved to approve vouchers in the amount of $262,536.11, seconded by Supervisor Harenda, voted on, carried unanimously.

Included in the approved vouchers were: $165,922.69 to Sanitary District Number 4 for 1999 final payment of special assessment on the tax bills; $37,017.49 to Brookfield Convention and Visitor Bureau for 2nd quarter room tax and $9,193.89 to Cramer, Multhauf & Hammes for attorney fees.

CLOSED SESSION (9:45 P.M.)

Supervisor Harenda moved to adjourn into Closed Session, according to Section 19.85(1)(c) Wisconsin Statutes to consider renewal of the Town Administrator’s contract, seconded by Supervisor Johnson, voted on, carried unanimously.

Supervisor Harenda moved to adjourn into Closed Session, according to Section 19.85(1)(e) Wisconsin Statutes for deliberation of Police and Fire Commission decisions regarding fire department grievances, seconded by Supervisor Timm, voted on, carried unanimously

OPEN SESSION (10:50 P.M.)

Supervisor Timm motioned adjournment into Open Session according to Section 19.85(2) Wisconsin Statutes, for any necessary action resulting from the Closed Session, seconded by Supervisor Harenda, voted on, carried unanimously.

Supervisor Talsky moved to lay over renewal of the Town Administrator’s contract to September 20, 2000, seconded by Supervisor Johnson, voted on, passes 3 – 2 with Chairman Henderson and Supervisor Johnson voting nay.

There being no further business Supervisor Talsky moved to adjourn, seconded by Supervisor Johnson, voted on, carried unanimously. The meeting adjourned at 10:55 p.m.
