                                                         September 20, 2000

The regular meeting of the Town Board was held on Wednesday, September 20, 2000 in the Erich Gnant Room of the Town Hall, 645 N Janacek Road, Brookfield, WI.

Chairman Keith Henderson called the meeting to order at 7:00 p.m. with the following people present: Supervisors: Jeffrey Timm, Keith Harenda and Leo Talsky, Attorney James Hammes, Administrator Richard Schultz and the Town Clerk to record the minutes.

MEETING NOTICE VERIFICATION

The Clerk reported that notice of this meeting was faxed to the newspapers and posted at the Town Hall on September 15, 2000. The Police Department posted the notice on September 16, 2000 on the bulletin board located at Woelfel Road & Wisconsin Avenue and September 17, 2000 on the bulletin boards located at Mayrose Boulevard, Davidson Road, Weyer Road and Marx Park. The addendum was faxed to the newspapers and posted on September 20, 2000.

MINUTES

Chairman Henderson said that on page 2, paragraph four the minutes should include Village in front of Menomonee Falls, City in front of New Berlin and Waukesha and the City of Brookfield would not talk if there are not perceived advantages to them.

Supervisor Harenda moved to dispense with the reading of the minutes of the August 15, 2000 Town Board meeting and approve them as corrected, seconded by Supervisor Talsky, voted on, carried unanimously.

PUBLIC COMMENT None.

SPECIAL TOWN MEETING

Supervisor Harenda moved to endorse the electors decision at the September 19, 2000 Special Meeting and to go ahead with the Building Project not to exceed $4,000,000.00 (four million dollars), seconded by Supervisor Talsky, voted on, carried unanimously.

CIVIL ENGINEERING SERVICES

Supervisor Timm moved to approve the proposal for Civil Engineering Services for a topographic and boundary survey for the Town Hall renovations not to exceed $5,300.00 in cost, seconded by Supervisor Talsky, voted on, carried unanimously.

SALARY ORDINANCE

Supervisor Johnson moved to adopt An Ordinance Amending The Salary and Hourly Wage Rate Adjustment Schedules of Non-Union Personnel of the Town of Brookfield for the Years 2000, 2001 and 2002, seconded by Supervisor Talsky, voted on, carried unanimously.

VACATING A PORTION OF BRIAR RIDGE DRIVE

Supervisor Timm moved to table the vacating of a portion of Briar Ridge Drive, seconded by Supervisor Johnson, voted on, carried unanimously.

SET DATE FOR PUBLIC HEARING REZONING LAND WEST OF BROOKSIDE CHEVROLET

Supervisor Timm moved to set 7:00 p.m. on October 17, 2000 as the time and date for the Public Hearing for the rezoning of land west of Brookside Chevrolet at 20445 W. Capitol Drive, from T-1 and C-1 to B-2 and C-1. The motion was seconded by Supervisor Johnson, voted on, carried unanimously.

SET DATE FOR PUBLIC HEARING FOR REZONING LAND NORTH OF GUMINA

Withdrawn.

PLAN COMMISSION RECOMMENDATIONS

FINAL APPROVAL OF AN ADDITION AT 180 KOSSOW ROAD

Supervisor Harenda moved to grant final approval of an 1,100 square foot addition at 180 Kossow Road subject to the Plan Commission recommendations and adding more than four and less than twelve evergreens to the front of the parking lot, seconded by Supervisor Talsky, voted on, carried unanimously.

CONCEPTUAL APPROVAL OF REDEVELOPMENT AT 21005 GUMINA ROAD

Supervisor Johnson moved to grand conceptual approval of a 10,000 square foot daycare redevelopment at 21005 Gumina Road, seconded by Supervisor Harenda, voted on, carried unanimously.

REFUND REQUEST FOR CANCELLED BARTENDER LICENSE

Supervisor Johnson moved to approve a refund of the fee paid by Stacy Regynski for a bartender license minus five dollars ($5.00) the amount of the investigative fee, seconded by Supervisor Harenda, voted on, carried unanimously.

BARTENDER LICENSES

Supervisor Johnson moved to table the request for a bartender license for Ricky Negley pending the Police Chief’s review of the background record and recommendation and clarification regarding the license renewal, seconded by Supervisor Timm, voted on, carried unanimously.

BUILDING INSPECTOR’S REPORT

Inspector Lake explained that by January 6, 2000 the Town should request an amendment of Waukesha County Development Plan to include the Town’s Capitol Drive Corridor Plan.

CLERK’S REPORT None.

ADMINISTRATOR’S REPORT None.

CORRESPONDENCE

The attached list of correspondence was reviewed by members of the Board, with comment on the following:

  1. Attorney Hammes said that it is a formality to file a notice of claim with regards to the concrete dam at 19710 W. Briar Ridge Drive.
  1. Chairman Henderson said that someone should attend the Wis 59 meeting.

VOUCHERS

Supervisor Johnson moved to approve payment of vouchers in the amount of $79,184.13, seconded by Supervisor Harenda, voted on, carried unanimously.

Included in the approved vouchers were: $24,129.91 to Graef, Anhalt, Schloemer & Assoc. for engineering fees; $20,062.49 to Ruekert & Mielke for engineering fees and $6,634.75 to WPRA for discount tickets sold through the Recreation Department.

DISCUSS OF ITEMS ONLY

Supervisor Johnson said that she is concerned about a barn at 19870 Timberline Drive not being structural sound and possibly a safety hazard.

ADDENDUM REQUEST FOR LICENSE FOR GOING OUT OF BUSINESS SALE AT 18000 W BLUEMOUND ROAD

Supervisor Johnson moved to deny the extension to December 31, 2000 of a license to go out of business for Expressions Custom Furniture, at 18000 W. Bluemound Road, Brookfield, WI, seconded by supervisor Timm, voted on, carried unanimously.

CLOSED SESSION (8:20 P.M.)

Supervisor Harenda moved to adjourn into Closed Session, according to Section 19.85 (1)(g) Wisconsin Statutes for the purpose of conferring with legal counsel regarding possible threatening litigation. Section 19.85(1)(c) Wisconsin Statutes for the purpose of reviewing the ordinance, performance evaluation and contract of the Town Administrator, seconded by Supervisor Talsky, voted on, carried unanimously.

OPEN SESSION (9:10 P.M.)

Supervisor Johnson moved to adjourn into Open Session according to Section 19.85(2) Wisconsin Statutes for any necessary action resulting from the Closed Session and to adjourn the meeting, seconded by Supervisor Timm, voted on, carried unanimously.

Supervisor Timm moved to amend Ordinance 1.16 (3) (A) (13) relating to duties of the Administrator changing the wording Supervisors to Town Board, seconded by Supervisor Talsky, voted on, carried unanimously.

There being no further business Supervisor Timm moved to adjourn, seconded by Supervisor Johnson, voted on, carried unanimously. The meeting adjourned at 9:20p.m.
