Pro Tem Chairperson Jeffrey Timm called the meeting to order at 7:00 p.m. with the following people present: Supervisors Keith Harenda, Carol Johnson and Leo Talsky, Attorney James Hammes, Administrator Richard Schultz and the Town Clerk to record the minutes. Chairman Keith Henderson was absent.
MEETING NOTICE VERIFICATION
The Clerk reported that notice of this meeting was faxed to the newspapers and posted at the Town Hall on March 2, 2001. The notice was posted by the Police Department on March 2, 2001, on the bulletin boards located at Woelfel Road & Wisconsin Avenue and Marx Park, and on March 3, 2001 at Davidson Road, Weyer Road and Mayrose Boulevard.
MINUTES
Supervisor Harenda moved to dispense with the reading of the minutes of the February 6, 2001 Town Board meeting and approve them as presented, seconded by Supervisor Talsky, voted on, carried unanimously.
Supervisor Johnson moved to dispense with the reading of the minutes of the February 22, 2001 Town Board and approve them as presented, seconded by Supervisor Harenda, voted on, carried unanimously.
PUBLIC COMMENT
Dean Pearson stated that for the December 19, 2000 Town Board meeting he submitted a letter to all of the Board members and it has never appeared as part of any of the meeting minutes.
The Clerk said that documentation or correspondence that relates to an agenda item are not always listed or recorded in the minutes unless specified to be so.
Supervisor Talsky said that the correspondence Mr. Pearson submitted was a fairly significant commentary to the board and thinks it should be a part of the official file. He requested that the attached December 19, 2000 letter become a part of these minutes.
SNOW REMOVAL ORDINANCE
Supervisor Johnson moved to table the Snow Removal Ordinance until the next Town Board meeting, seconded by Supervisor Talsky and voted on, carried unanimously.
HUMANE ANIMAL SERVICES
Supervisor Johnson moved to table the Humane Animal Services Program until contract information is available, seconded by Supervisor Harenda, voted on, carried unanimously.
STORM WATER UTILITY BOARD
Supervisor Johnson moved to table the creation of a Storm Water Utility Board until such time that a presentation by Graef, Anhalt & Schloemer the Town Engineering firm can be given to the Town Board, seconded by Supervisor Harenda, voted on, carried unanimously.
SEWER EXTENSION NORTH SIDE OF CAPITOL DRIVE
Supervisor Harenda moved to direct Sanitary District #4 to have their Engineering firm prepare preliminary plans for extending sewer to the north side of Capitol Drive, provide cost estimates and obtain DNR permits, with the monies coming from the contingency fund. The motion was seconded by Supervisor Johnson and voted on, carried unanimously.
Plan Commissioner Dean Pearson asked that the Town Board give the Plan Commission direction on how to handle development request for the north side of Capitol Drive. He said one thing he thought of is for what would be considered light use development, should the Commission be looking at allowing for holding tanks, as temporary facilities until the availability of the sewer services. This approval could include a Development Agreement that would requirement hook up to the service immediately upon availability.
Supervisors Johnson and Harenda said they agree the Town needs to move forward with development in this area so a strategic plan needs to be designed until they can hook up to municipal service.
Supervisor Talsky said that he thinks this should be an agenda item for the Plan Commission and Town Board meetings, pertaining to Development on Capitol Drive with regards to temporary facilities for sewer and/or water services.
CDBG PROGRAM APPLICATION
Supervisor Johnson moved to authorize the Administrator to get the Community Development Block Grant Program application by E-mail, seconded by Supervisor Talsky, voted on, carried unanimously.
SURPLUS POLICE VEHICLE
Supervisor Timm said that he has reconsidered the Town keeping the surplus police vehicle for the administrative staff to use for official business because it could possibly be in need of repair. If a vehicle is needed then the Town should budget for a new appropriate vehicle next year.
Supervisor Johnson moved to rescind the previous motion of keeping the best of the two surplus police vehicle for use by Town administrative staff for official business, instead the vehicle is to be sent to auction with the other car, seconded by Supervisor Harenda, voted on and carried unanimously.

ADMINISTRATORS REPORT
Administrator Schultz said that he attended the shared dispatch meeting today and reported that the first years cost for the Town of Brookfield, including operating and infrastructure is $128,807.00. He explained that further discussion at the meeting went in the direction that there is no guarantee that the cost will be affordable in the second, third or fifth year. Also, that the City of Brookfield and the City of Waukesha were complaining regarding their cost to the system and if either one or both pull out the program would be shelved because it would be to much for the remaining communities to pick up the difference. The bottom line is they will be reviewing the cost and come up with different scenarios to evaluate long term cost as well as developing a consensus of board and council members buying into the system so they can calculate long term cost.
Supervisor Johnson asked if the concern was that it is not being distributed equitably.
Administrator Schultz said that there were a couple issues raised one being the representation on the Executive Board and the other question was with regards to how the methodology was used for cost allocation.
He also reported that the Greater Brookfield Convention and Visitor Bureau is having a strategic seminar to discuss the direction and purpose of the bureau.
CORRESPONDENCE
The Board members reviewed the attached list of correspondence, and no one had any comment.
A letter was presented dated March 1, 2001 from Brian Cameron putting the Town on notice of the intention to start legal action against the Town regarding the detention pond near Postillion Condominiums. Supervisor Harenda asked Attorney Hammes if he had gotten a legal opinion on this situation.
Attorney Hammes said that he is researching the history of all the development in that area.
Attorney Hammes presented a letter dated March 6, 2001 to George Hall regarding the Incorporation of the Town of Brookfield.
VOUCHERS
Supervisor Johnson moved to approve payment of vouchers in the amount of $232,015.78, seconded by Supervisor Talsky, voted on and carried unanimously.
Included in the approved vouchers were: $100,553.10 to the Zimmerman Design Group for work on the Town building project; $11,964.22 to Foxhaven LLC for overpayment of taxes; $5,961.00 to Brookfield/Butler for 2001 annual insurance and retainer fees; $5,904.00 to Radio Communication Co for pagers for the Fire Department and $4,382.74 to Ruekert & Mielke for engineering fees.
DISCUSSION ONLY
Supervisor Johnson said that she read the report on the indoor soccer field in the City of Brookfield and wondered if Inspector Lake should send correspondence to the City regarding the Towns concerns and issues.
The consensus of the board was that it was too late to respond since the city had already made their decision and approved the development.
CLOSED SESSION (8:35 P.M.)
Supervisor Harenda moved to adjourn into CLOSED SESSION, according to Section 19.85(1)(c) Wisconsin Statutes to consider employment performance evaluations, seconded by Supervisor Johnson and voted on, carried unanimously.
OPEN SESSION (8:45 P.M.)
Supervisor Timm moved to adjourn into OPEN SESSION pursuant to Section 19.85(2), Wis. Stat. for any necessary action resulting from the Closed Session and to adjourn the meeting, seconded by Supervisor Talsky, voted on, passed unanimously
Supervisor Talsky moved to accept the Police Chiefs performance evaluation and approve the recommended merit increase for the Police Captain, seconded by Supervisor Johnson vote on and carried unanimously.
Supervisor Talsky moved to send back the performance evaluation of the Assessor, Building Inspector and Fire Chiefs Clerical Assistant, for the development of goals for the up coming year, seconded by Supervisor Johnson vote on and carried unanimously.
There being no further business Supervisor Talsky moved to adjourn, seconded by Supervisor Harenda, voted on, and carried unanimously. The meeting adjourned at 8:50 p.m.
